Dallas County Sheriff’s Department investigators missed important evidence during an initial search of the Lancaster home where a brutal March 2011 domestic violence assault occurred, according to testimony Monday in the trial of the man charged in the case.
Two investigators who searched the home of the victim of a rape, stabbing and mutilation testified they did not initially see a tote bag on the floor of her living room. Among items inside the bag were a knife block, a knife sharpener and bloody knives and clothing.
Jose Arreola, 34, faces up to life in prison if convicted in the attack that left his girlfriend critically injured. His bloody clothing was also in the tote bag, which investigators did not see even though it is pictured in several crime scene photos they took, according to testimony.
The Dallas Morning News does not generally identify victims of sexual assault.
“Clearly the bag was there?” prosecutor Brandie Wade asked one of the investigators.
“Yes, ma’am,” said John Ludwigs, a physical evidence detective.
“But it was missed?” Wade asked.
“Yes, ma’am,” Ludwigs said.
Investigators did discover a large knife in the kitchen sink that was broken at the handle. It appeared to have been washed, according to testimony.
The 43-year-old woman, who testified over three days last week, suffered deep cuts to her face, breasts and sexual organs. Days after the attack, the victim’s relatives were cleaning her house when they discovered the tote bag and notified investigators. Ludwigs also testified he lost about 60 to 70 percent of his crime scene photos because his camera malfunctioned. But he said he also produced a video recording of the crime scene.
The crime scene stretched from the back porch of the home, where the attack is believed to have started, and inside through several rooms of the house. Investigators also missed bloody clothing thought to have been worn by the victim. The victim’s relatives put it in plastic bags in her garage when they were cleaning and the victim found it months later.
