With state investigators looking into possible improprieties in how Athens County Sheriff Pat Kelly runs his office – reportedly including how he has handled the disposal of county property – questions have now arisen about the sheriff's possible scrapping of a donated vehicle. 

Though the county officially declared the vehicle surplus only last month, there are indications it had already been scrapped when this was done – possibly as much as one to three years ago. 

Kelly did not respond to three emails from The Athens NEWS seeking information about the issue. Minutes of an Athens County Commissioner meeting from July 25, however, confirm that on that date, the commissioners granted a request from Kelly's office to declare as surplus a high-mileage 1983 Chevrolet truck, described by officials as a former bread delivery truck that was obtained by the county in 2009, reportedly as a donation. 

The county still holds the title to the vehicle, though a notation on the back of the document indicates that ownership was assigned to a local salvage/parts company on the day of the commissioners' meeting at which it was declared surplus. At this point, no county official seems to know for sure where the truck is located, or whether it's still intact. Kelly has sent the vehicle to be scrapped. 

"My understanding is, it was sent to (the local scrap company) by the sheriff," he said.

If this is true, he added, then proper procedure was not followed – the request to declare the truck surplus should have been made prior to its being scrapped. 

"It should have been done before," he said. 

The vehicle shows up on the county's 2011 list of capital assets, but then disappears from the 2012 list. County deputy auditor Alan Ferguson said that the presence of the truck on the 2012 prior-disposal list means it should have been removed from the 2011 capital assets list, but for some reason was not – in other words, the vehicle was probably disposed of sometime prior to last year.
